So, in Florida, different jurors could believe different aggravating factors are present and there is no way to know. Also, there does not have to be a unanimous vote for the death penalty. Only Florida allows a jury to recommend death by a simple 7 to 5 majority. Scholars argue this lessens the jury’s view of their importance in the process.
